1. Definitions

In these Terms and Conditions:

  • "Service" refers to the protected residential rental services provided by Elysian Keys
  • "We," "Us," "Our" refers to Elysian Keys
  • "User," "You," "Your" refers to the individual or entity accessing our services
  • "Property" refers to any residential space managed by Elysian Keys
  • "Agreement" refers to these Terms and Conditions together with any rental lease agreement

2. Acceptance of Terms

By accessing our website, submitting rental inquiries, or entering into a rental agreement with Elysian Keys, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

You must be at least 18 years of age and have the legal capacity to enter into binding contracts under Thai law. If you are acting on behalf of an organization, you represent that you have authority to bind that organization to these terms.

3. Service Description

Elysian Keys provides property management and rental services for protected residential spaces in Bangkok, Thailand. Our services include:

  • Property viewings and rental consultations
  • Lease arrangement and documentation
  • Security system management and monitoring
  • Property maintenance coordination
  • 24-hour emergency support for security and property concerns

Service availability is subject to property availability and may vary based on location and property type. We reserve the right to modify or discontinue services with reasonable notice to current tenants.

4. Rental Application Process

Rental applications are subject to the following procedures:

4.1 Application Requirements

  • Completed application form with accurate information
  • Valid identification documents
  • Employment and income verification
  • Background check consent and processing
  • Emergency contact information

4.2 Approval Process

Applications are reviewed based on security screening results, rental history, and income verification. Approval is at our discretion and does not guarantee property availability. Rejected applications will be notified with general reasons within 5 business days.

5. Lease Terms and Rental Payments

5.1 Rental Rates

Rental rates are specified in individual lease agreements and include property management and security system maintenance. Rates are quoted in Thai Baht (THB) and may be subject to change with 60 days notice for renewals.

5.2 Payment Terms

  • Payments must be made in Thai Baht through specified payment methods
  • First payment includes first period rent plus security deposit
  • Subsequent payments due on the specified date each rental period
  • Late payments may incur fees as specified in the lease agreement

5.3 Security Deposits

Security deposits equal to one to two rental periods will be held for property protection and returned within 30 days of lease termination, less any deductions for damages beyond normal wear and tear. Detailed condition reports are provided at move-in and move-out.

6. User Responsibilities

6.1 Property Use

You agree to:

  • Use the property solely for residential purposes as intended
  • Maintain the property in good condition
  • Comply with all security protocols and access procedures
  • Report maintenance issues and security concerns promptly
  • Respect quiet hours and community regulations where applicable

6.2 Prohibited Activities

The following activities are strictly prohibited:

  • Illegal activities or violations of Thai law
  • Subletting or unauthorized occupancy
  • Tampering with or disabling security systems
  • Causing damage to property or common areas
  • Excessive noise or disturbances affecting neighbors
  • Modifications to property without written approval

6.3 Security Systems

You are responsible for proper use of security systems, maintaining confidentiality of access codes, and reporting any system malfunctions immediately. Unauthorized sharing of access codes or attempts to circumvent security measures constitute breach of agreement.

7. Property Access and Inspections

We reserve the right to access the property with reasonable notice (typically 24 hours) for:

  • Routine inspections and maintenance
  • Security system maintenance and upgrades
  • Emergency repairs or safety concerns
  • Property showings to prospective tenants (during notice period)

Emergency access may be necessary without prior notice for urgent repairs or security concerns.

8. Disclaimers

While we implement appropriate security measures, we cannot guarantee absolute security or prevent all incidents. Our services are provided "as is" without warranties of any kind, express or implied.

We are not responsible for:

  • Personal property loss or damage (renters insurance recommended)
  • Security breaches caused by tenant negligence or misconduct
  • Service interruptions due to circumstances beyond our control
  • Neighbor disputes or community matters outside our jurisdiction

9. Limitation of Liability

To the maximum extent permitted by Thai law, our liability for any claims arising from these terms or your use of our services is limited to the amount of rent paid during the three months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

10. Termination

10.1 Termination by Tenant

You may terminate the lease agreement with written notice as specified in your lease (typically 30-60 days). Early termination may result in forfeiture of deposits or fees as outlined in the lease agreement.

10.2 Termination by Elysian Keys

We may terminate the agreement immediately if you:

  • Fail to pay rent or other charges when due
  • Violate security protocols or property rules
  • Engage in prohibited activities
  • Cause significant property damage
  • Breach any material term of the agreement

10.3 Effects of Termination

Upon termination, you must vacate the property, return all keys and access devices, and allow final inspection. Security deposits will be processed according to the deposit terms outlined above.

11. Dispute Resolution

In the event of disputes, both parties agree to first attempt informal resolution through good-faith negotiation. If resolution cannot be reached within 30 days, disputes will be submitted to mediation before pursuing legal action.

These Terms are governed by the laws of Thailand. Any legal proceedings shall be conducted in Thai courts with jurisdiction over Bangkok.

12. General Provisions

12.1 Entire Agreement

These Terms, together with your lease agreement and our Privacy Policy, constitute the entire agreement between you and Elysian Keys regarding our services.

12.2 Severability

If any provision is found unenforceable, the remaining provisions will continue in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision does not constitute waiver of that right or provision.

12.4 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights to affiliated entities or successors.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through email to current tenants at least 30 days before they take effect. Continued use of our services after changes constitutes acceptance of the modified Terms.

For current lease agreements, material term changes will not apply until lease renewal unless mutually agreed.
